The overall divorce rate in the U.S. has generally been declining. As of 2022 (the most recent comprehensive national data), the rate was around 2.4 divorces per 1,000 people, down significantly from previous decades. While the overall divorce rate is decreasing, divorce among older adults (often called "gray divorce" for those over 50) is increasing. The divorce rate for couples aged 65 and older tripled between 1990 and 2022. Concurrently, there's a growing trend towards alternative divorce methods like mediation and collaborative divorce, as well as an increase in individuals handling their divorce pro se (without an attorney), often facilitated by online resources. Interest in online divorce searches notably increased in 2024. In 2024, while the divorce rate for first marriages in the U.S. is estimated to be between 40-50% (and declining), the rate increases significantly for subsequent marriages. Around 60% of second marriages end in divorce, and the rate for third marriages is even higher, at approximately 73%. The average cost of a divorce in the U.S. in 2024 is estimated to range between $7,000 and $15,000. However, this figure can rise substantially for cases involving significant conflict or substantial assets. According to a survey of family law attorneys, the average cost for a prenuptial agreement is around $8,000 per couple.
